Sea Sand Art Source — Artist Consignment Agreement
Between Sea Sand Art Source (Sandy, trading as a sole trader — "the Gallery") and you ("the Artist"). Sea Sand Art Source is a virtual gallery with no physical premises.
1 · Purpose & consigned works
You consign your original works to the Gallery for marketing, display and sale on the website, your artist page, and virtual exhibitions. Each work you add — title, medium, dimensions, year, retail price (TTD) and condition — forms your Schedule A. You may add more works at any time; this form updates your Schedule A automatically.
2 · You keep possession until sold
You keep ownership and physical possession of every work until it sells, and are responsible for its storage, care and insurance until then. When a work sells and payment clears, the Gallery collects it from you to prepare and ship to the buyer.
3 · Commission & payment
On each sale (net of payment-processing fees): Artist 70%, Gallery 30% commission. The Gallery pays your share within 14 days of cleared payment, with a statement of sale. Retail prices are set in Schedule A and won't be discounted more than 10% without your written consent.
4 · Term & termination
Continues until either party ends it with 30 days' written notice (or immediately for an uncured material breach). On termination the Gallery removes your listings within 14 days; any confirmed sale is completed.
5 · Shipping & framing
Framing and shipping are paid by the buyer, added on top of the retail price — separate from, and never reducing, your 70/30 split. In transit, the work is in the Gallery's care and insured by the Gallery.
6 · Rights & marketing
You keep all copyright. You grant the Gallery a non-exclusive, royalty-free licence to reproduce images of your works only to market, catalogue and sell them, and you're credited by name throughout. No merchandise or print reproduction without your written consent.
7 · Non-exclusive
You may sell through other galleries or directly — but a work listed here can't be sold elsewhere while it's consigned, without telling the Gallery first.
8 · General
Governed by the laws of the Republic of Trinidad & Tobago. You sign as an independent contractor, and warrant each work is your original creation, free of any claim, and infringes no one's rights.
